MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD MAY 26, 1987 <br />#1141 RARLTON GEMPLER /MARIA IVES CONT. <br />It was moved by Councilmember Goetten, seconded by <br />Councilmember Peterson, to adopt Resolution #2187 <br />granting the variance per staff recommendation with the <br />amendment of hardcover in the 75 -250' zone from 32.5% to <br />34.25 %. Motion: Ayes 4, Nays 1. Mayor Grabek voted <br />nay. <br />#1132 DOUGLAS BUMGARDNER <br />3800 WEST WAYZATA BOULEVARD <br />CONDITIONAL USE PERMIT <br />RESOLUTION #2188 <br />Douglas Bumgardner was present for this matter. <br />City Administrator Bernhardson explained the Vie de <br />France /Summerfield Farms at the corner of County Road 6 <br />and Highway 12 is a legal non - conforming use. A number <br />of years ago the City undertook to try to control use <br />the spread of. the. commerical use of the property. <br />Subsequent to that they adopted a very restrictive use <br />of that property under Resolution No. 1377. When it <br />changed hands, the pertinent sections that are noted <br />tonight were also incorporated in resolution #1646 which <br />included a prohibition on the delicatessen use and a <br />mini bakery. Following that in Resolution #1735 which <br />was approved in March 11, .1985, the owners were approved <br />the use of a mini bakery and delicatessen. They did <br />install the mini bakery but not the delicatessen. The <br />application is three fold, the first is that the current <br />resolution states that if it wasn't sold to one of a few <br />parties, it had to come to Council for approval of the <br />sale; .`and secondly.,. because the delicatessen was not put <br />in at the time that it was approved, they are requesting <br />that use be approved; and thirdly, they would like to do <br />some rearranging within the footprint of the retail <br />store by changing the furnace thus reducing that needed <br />area plus rearrangement of the office area and thereby <br />adding -90 s.f. of retail space. One issue is does the <br />90 s.f V classify as an intensification of the commercial <br />use of the property? <br />Mr. Bumgardner clarified that there will be no change in <br />actual retail space, as the office area is being <br />relocated in an area already classified as commercial <br />floor area that would be equal in area to 90 s.f. <br />It wa. moved 'by Councilmember Goetten, seconded by <br />Councilmember Peterson, to adopt Resolution #2188 <br />approving the conditional use permit as proposed <br />amending the resol,ution•to--ref lect no increase in retail <br />space proposed. Motion, Ayes 4, Abstention 1. Mayor <br />Grabek abstained. <br />10 <br />
