MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD APRIL 27, 1987 <br />#1117 WILLARD C. SHULL <br />1125 SPRING HILL ROAD <br />VARIANCE <br />RESOLUTION <br />City Administrator Bernhardson explained that this <br />application was tabled at the last meeting pending <br />additional information from staff regarding general <br />conditions of harships and findings in which variances <br />for construction of boat tracks within the 0 -75' would <br />be allowed. <br />Zoning Administrator Mabusth submitted photos taken by <br />staff of many such existing structures around the City <br />noting that these structures were located on lakeshore <br />properties with varying physical conditions i.e. mucky <br />bottom, sandy bottom. <br />Mrs. Shull was present and stated that they love their <br />lakeshore and are very protective of it feeling a boat <br />track would be the best answer to their problem of a <br />soft bottom. They felt that dredging would upset the <br />abundant wildlife on their shoreline. <br />Councilmember Callahan felt that sufficient information <br />was submitted by staff to substantiate this particular <br />structure, therefore, moved to recommend approval. <br />Councilmember Sime seconded the motion stating he was <br />not concerned with this particular structure in this <br />particular area but feared there were areas which could <br />not possible handle these structures. <br />Mayor Grabek felt there was no justification for this <br />type of structure within the 0 -75' feeling there were <br />other ways to remedy a mucky bottom. He felt it would <br />set a bad precedent and that the City should start to <br />control these type of structures by denying all requests <br />and handling the removal of existing structures upon <br />complaint. He felt the existing structures were <br />basically grandfathered in. <br />Councilmember Goetten agreed with Mayor Grabek about <br />allowing structures within the 0 -75' area. However, in <br />this particular area and this particular structure, she <br />would much prefer this'structure as opposed to dredging. <br />She felt these structures would be an acceptable <br />alternative to dredging with appropriate standards. <br />City Attorney Blatz stated that the property owner has a <br />right to navigational access, be it a stabilized dock, a <br />boat track, a 100' dock, or dredging, etc. <br />9 <br />
