Based on the survey,the slopes within the first 20-25 <br /> feet down slope from the driveway bed range from 28-32 percent for the length of the proposed house. <br /> Gaffron noted the issues in this application relate not only to slope stability but also aesthetics. <br /> Gaffron pointed out there may be a way to construct a house if they are granted a 25-foot setback to the <br /> west and south where normally 30 feet is required and a 25-foot setback to the street where a 50-foot <br /> setback is required. By building in that area, it would allow them to construct a house consisting of 1,440 <br /> square feet and a garage of 710 square feet,which is approximately a 2,150 square feet. Gaffron <br /> indicated they could do some regarding within the bluff impact zone to perhaps create a walkout in the <br /> setback area. Gaffron indicated the neighbor's tennis court would be in close proximity to the house but <br /> that it likely will not be a huge impact since it would be used sporadically. <br /> Based on that option, Staff recommends the following: <br /> 1. Approval of an average lakeshore setback variance; <br /> 2. Denial of the bluff setback variance; <br /> 3. Denial of the variance to encroach into the bluff impact zone with structure; <br /> 4. Allowance for limited grading within the bluff impact zone to allow for a walkout door. <br /> 5. Approval of a setback variance to allow the home/structure up to 25 feet from the rear(street) <br /> property line; <br /> 6. Approval of left and right side setbacks of 25 feet to allow for a house/garage footprint of <br /> approximately 2150 square feet. <br /> Gaffron noted Staff has outlined some issues in the report that the Planning Commission should discuss. <br /> Levang asked if the house has been moved forward essentially compared to the proposal from the <br /> applicant. <br /> Gaffron stated the house has been moved forward five feet to the street and slightly narrowed. <br /> Landgraver asked whether this option has been discussed with the applicant and his engineers. <br /> Gaffron indicated it has not been discussed with the applicant, and that the intent of it was to show that <br /> some kind of house could be constructed if some variances are allowed. Gaffron noted this would avoid <br /> the need to grant some type of variance to the bluff. <br /> Schoenzeit asked if the City has any liability if the homeowner does not follow some of the City's <br /> recommendations and the house experiences problems. <br /> Gaffron stated in his opinion the City would not be at fault if the Planning Commission approves <br /> something as long as they do not make any statements about guaranteeing slope stability. <br /> Page 7 <br />
