MINUTES OF THE <br /> ORONO PLANNING COIVIMISSION MEETING <br /> Monday,April 16,2012 <br /> 6:30 o'clock p.m. <br /> the owner or occupant of the property except when licensed as a joint use. That language currently exists <br /> in the code but is in different sections of the code,which makes it difficult to explain to property owners. <br /> Landgraver stated in his view they should direct Staff to draft some language and then hold another public <br /> hearing to obtain any other input from the general public. <br /> Schoenzeit reopened the public hearing at 7:00 p.m. <br /> Richard Anderson,3205 Crystal Bay Road,noted the Planning Commission voted 6-0 to accept the <br /> language that Staff has proposed. Anderson indicated he is the owner of three marinas in Orono and that <br /> he is opposed to allowing rental of residential docks. The majority of the public at the last Planning <br /> Commission meeting also indicated they were opposed to the rental of residential dock slips. The <br /> Planning Commission voted 6-0 to accept Staff's language and the text amendment then went to the City <br /> Council. Only one council member was opposed to the vote. Anderson indicated he is not sure what the <br /> motive is of that council member to send it back to the Planning Commission since they have already <br /> recommended approval of the language. <br /> Schoenzeit stated he did attend the City Council meeting where this was discussed and that the City is <br /> working to create ordinances that are reasonable and fair. Schoenzeit noted there is language in the text <br /> amendment that would prohibit residents from doing certain things and that the ordinance needs to be <br /> examined and thoroughly discussed prior to it being adopted. If the current ordinance is broken, it needs <br /> to be adjusted and all options need to be considered. Schoenzeit indicated the City wants to look at it <br /> further to see if the language can be made to match the usage. <br /> Anderson asked what the intent of the meeting was last month. <br /> Schoenzeit indicated the intent was to get public input on the draft text amendment and that additional <br /> questions were raised at the City Council meeting. Schoenzeit commented there are different options to <br /> deal with some of these issues,particularly as they relate to parking,without impacting what happens in <br /> the water. <br /> Anderson questioned whether there should be a B2 District anymore. Anderson asked how the B2 <br /> District would be protected. <br /> Schoenzeit stated those are fair questions and need to be looked at. Schoenzeit noted there is no new <br /> recommendation to review or approve the text amendment and that protection for nonrental is well <br /> established in the City's current code. <br /> Levang noted there was no legal notice of a public hearing tonight,which is part of the concern of the <br /> Planning Commission. The process typically is that no legal notice is required when an application is <br /> tabled,but that the Planning Commission wants to make sure that the public has ample notice of this text <br /> amendment. <br /> Anderson asked what additional direction the Planning Commission is giving to Staff and the City <br /> Council. <br /> Schoenzeit stated the City will continue to review the amendment to see what other options are available. <br /> Page 5 <br />
