MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Tuesday,January 17,2012 <br /> 6:30 o'clock p.m. <br /> Thiesse pointed out it is the driveway that has the right-of-way and that the people on the Luce Line have <br /> a stop sign. <br /> Landgraver commented that unfortunately people tend to ignore stop signs on the Luce Line and that <br /> perhaps the equipment operators should take the time to check for people on the Luce Line before <br /> � crossing it. <br /> Thiesse commented that a lot of times the truckers are alone in the truck and that it would be difficult to <br /> get out of the truck to see if there is anybody on the Luce Line. <br /> Schoenzeit stated he would require the applicant to maintain a safe construction site. <br /> Landgraver noted both adjoining properties have propane tanks and that a large vehicle navigates and <br /> crosses the Luce Line to fill those tanks. <br /> Thiesse commented there will be all kinds of trucks being used during construction and that it will be <br /> difficult to place standards on that type of activity. <br /> Levang suggested some type of signage be placed on the Luce Line alerting them to the construction. <br /> Rochel concurred that signage would be appropriate. <br /> Leskinen indicated she would agree with the verbiage that the City strongly encourages the applicant to <br /> alert users of the Luce Line to the construction rather than placing the burden on the City to monitor that. <br /> Thiesse stated he is not sure whether the applicant would have the right to place signage on the Luce Line. <br /> Schoenzeit moved,Levang seconded,to recommend approval of Application#12-3539,Anthony& <br /> Surya Rochel, 125 Turnham Road,granting of a lot area variance and conditional use permit, <br /> subject to staff recommendations,with the acknowledgement that the owner is accepting 100 <br /> percent responsibility for replacement of the culvert; to require an escrow in an amount deemed <br /> appropriate by the City Engineer for both the roadway and the trees; and to encourage the <br /> applicant to go beyond the minimum for maintaining a safe construction site both on their property <br /> and the adjacent properties. VOTE: Ayes 5,Nays 0. <br /> 6. #12-3540 CHARLES TRUWIT AND PAULA PICARD, 1105 FERNDALE ROAD WEST, <br /> VARIANCES AND CONDITIONAL USE PERMIT,8:16 P.M.—9:15 P.M. <br /> Charles Truwit,Paula Picard,Applicants; and Tom Owens,Attorney-at-Law,were present. <br /> Curtis stated back in 2009,CUP and variance approvals were granted in order to redevelop the property <br /> for sale.
