The amount to be removed is an area approxi.mately 17 feet wide and exceeds the <br /> current width of the road. <br /> 1, <br /> Landgraver stated it sounds like the request is to incorporate that sliver into the hardcover calculation, and <br /> then subject to a review of the easements,whether certain hardcover should be maintained. <br /> Schoenzeit stated they are going to direct the applicant to create a new survey showing that additional <br /> sliver in their hardcover calculations and they are also going to direct the City Attomey to provide an <br /> � opinion that the correct amount is being removed. <br /> Landgraver stated what is unclear is what the lanb age in the blue easement is and what are the <br /> requirements. � <br /> Curtis displayed the blue easement document on the overhead. <br /> Schoenzeit stated as long as you have a 12-foot wide path,that would constitute good access and any <br /> excess hardcover should be removed. <br /> Puzak noted the fire°department is akeady on record requesting 20 feet. <br /> Curtis stated she did speak to the police chief and fire chief and that their comments were regarding the <br /> restricted access that resulted from the placement of the pole and the boulders. <br /> Puzak stated there is more than 12 feet on the existing street and even more if you consider existing <br /> gravel. The Uniform Building Code•requires 20 feet. Puzak stated he would object to the hearsay that the <br /> 12 feet is allowable when it is not. <br /> Schoenzeit stated the City attorney has stated that 12 feet is fine. <br /> Wingerd stated if it is 20 feet,then everyone further down on Baldur Road is in violation. <br /> Schoenzeit moved to recommend approval of Application#11-352Q,Harold and Sandra Wingerd, <br /> 1376 Baldur Park Road,granting of hardcover variances per staff recommendations,subject to the <br /> applicants submitting,prior to the application going to the City Council,a completely updated <br /> survey showing sidewalks,adequate and accurate turnarounds,the proposed hardcover for the <br /> driveway,including the sfiver that is being re-added and what is to be removed,and also subject to <br /> the City Attorney confirming from the language contained within the blue easement that the <br /> Planning Commission is not requesting more hardcover to be removed than what is allowed. <br /> Thiesse asked if the City Attorney should also review whether the hardcover in the purple area is <br /> required. <br /> Schoenzeit stated the City Attorney should review the hardcover in total for the application versus what <br /> should remain. <br /> Thiesse seconded the motion.
