Granting of such permits is subject to other regulations and prohibitions <br /> of this Code and other applicable statutes or ordinances of other governmental bodies. <br /> Sec. 78-968. Permit. <br /> An application for a conditional use permit shall be accompanied by a drawing made by a <br /> registered surveyor or other competent person showing the location of the proposed excavation <br /> or storage and shall state the amount of material which is to be removed, excavated or stored, <br /> filled or graded, and such other information as the council may require. Applications shall be <br /> filed with the city administrator and shall be accompanied by a deposit to be determined by the <br /> � city, which will be used to offset the cost of processing the application. Any unused portion will � <br /> be refunded to the applicant. <br /> Background <br /> The subject property contains three separate parcels: 320 Woodhill Drive which contains the <br /> home and the circle portion of the driveway (this is where most of the work will occur); 322 <br /> Woodhill Drive which contains a portion of the driveway accessing Woodhill Drive; and 325 <br /> Woodhill Drive which fronts on Edgewood Hills Road and is vacant. <br /> The applicant is requesting approval of their project to replace and re-grade the existing <br /> driveway and correct a drainage issue near the home. Due to the amount of total earth <br /> movement proposed, a conditional use permit is required. The applicant has proposed <br /> approximately 1,000 cubic yards of total earth movement on site with approximately 400 cubic <br /> yards of soil material to be exported out of the property. The area of disturbance has been <br /> calculated by the applicant as 0.97 acre (Exhibit E), therefore an MPCA (State) issued National <br /> Pollutant Discharge Elimination System permit or NPDES permit is not required. <br /> Issues for Consideration • <br /> Are there any other issues or concerns with this application? <br /> Staff Recommendation <br /> Planning Staff recommends approval of the CUP. All of the City Engineer's requirements <br /> including erosion control measures should be addressed with the administrative land alteration <br /> permit following CUP approval. The applicant should be advised to contact the MCWD <br /> regarding review or permitting of the project. <br />
