1 SECTION 4.0 FLOODWAY DISTRICT(FW)
<br /> 2 78-1116 Permitted Uses: The following uses,subject to the standards set forth in Section 78-1117,are permitted
<br /> 3 uses if otherwise allowed in the underlying zoning district or any applicable overlay district:
<br /> 4 (1) General farming, pasture,grazing,outdoor plant nurseries, horticulture,truck farming,forestry,sod
<br /> 5 farming,and wild crop harvesting.
<br /> 6 (2) Industrial-commercial loading areas, parking areas,and airport landing strips.
<br /> 7 (3) Open space uses, including but not limited to private and public golf courses,tennis courts,driving ranges,
<br /> 8 archery ranges, picnic grounds,boat launching ramps,swimming areas, parks,wildlife and nature
<br /> 9 preserves,game farms,fish hatcheries,shooting preserves, hunting and fishing areas,and single or
<br /> 10 multiple purpose recreational trails.
<br /> 11 (4) Residential lawns,gardens, parking areas,and play areas.
<br /> 12 (5) Railroads,streets,bridges, utility transmission lines and pipelines,provided that the Department of Natural
<br /> 13 Resources'Area Hydrologist is notified at least ten days prior to issuance of any permit.
<br /> 14 78-1117 Standards for Floodway Permitted Uses:
<br /> 15 (1) The use must have a low flood damage potential.
<br /> 16 (2) The use must not obstruct flood flows or cause any increase in flood elevations and must not involve
<br /> 17 structures, obstructions,or storage of materials or equipment.
<br /> 18 (3) Any facility that will be used by employees or the general public must be designed with a flood warning
<br /> 19 system that provides adequate time for evacuation if the area is inundated to a depth and velocity such
<br /> 20 that the depth (in feet)multiplied by the velocity(in feet per second)would exceed a product of four upon
<br /> 21 occurrence of the regional (1%chance)flood.
<br /> 22 78-1118 Conditional Uses: The following uses may be allowed as conditional uses following the standards and
<br /> 23 procedures set forth in Section 78-1148 of this ordinance and further subject to the standards set forth in Section
<br /> 24 78-1119, if otherwise allowed in the underlying zoning district or any applicable overlay district.
<br /> 25 (1) Structures accessory to the uses listed in 78-1116(1)-(5)above and the uses listed below.
<br /> 26 (2) Extraction and storage of sand,gravel, and other materials.
<br /> 27 (3) Marinas, boat rentals,docks, piers,wharves,and water control structures.
<br /> 28 (4) Storage yards for equipment, machinery,or materials.
<br /> 29 (5) Placement of fill or construction of fences that obstruct flood flows. Farm fences,as defined in section
<br /> 30 2.918,are permitted uses.
<br /> 31 (6) Travel-ready recreational vehicles meeting the exception standards in Section 9.3.
<br /> 32 (7) Levees or dikes intended to protect agricultural crops for a frequency flood event equal to or less than the
<br /> 33 10-year frequency flood event.
<br /> 34 78-1119 Standards for Floodway Conditional Uses:
<br /> 35 (1) All Uses. A conditional use must not cause any increase in the stage of the 1%chance or regional flood or
<br /> 36 cause an increase in flood damages in the reach or reaches affected.
<br /> 37 (2) Fill;Storage of Materials and Equipment:
<br /> 38 (a) The storage or processing of materials that are, in time of flooding,flammable,explosive,or potentially
<br /> 39 injurious to human,animal,or plant life is prohibited.
