The application proposes to <br /> replace the vacated easement with a 10 foot d/u easement along the property line. There are <br /> no known utilities within the easement. <br /> Staff Recommendation: With the replaced easement, Planning Department Staff recommends <br /> approval of the easement vacation request. <br /> List of Exhibits <br /> ExhibitA. Application <br /> Exhibit 8. Survey(before) <br /> Exhibit C. Survey(after) <br /> Background <br /> The subjed property was originally parts of lot 3 and 4 Holly Acres 2"d Addition. When the <br /> boundary lines were adjusted to reflect the current configuration,the easements remained, <br /> now running through the middle of the property. This easement now impacts the development <br /> of a septic system, necessary to replace a substandard system. <br /> The applicants propose to provide a drainage and utility easement along the north property line. <br /> Statute allows the action "The governing body of a municipality may vacate any publicly owned <br /> utility easement or any portion thereof, which are not being used for sewer,drainage, electric, <br /> telegraph,telephone,gas and steam purposes or for boulevard reserve purposes." There are no <br /> known utilities within the easement,which a Gopher One Call response confirmed. The shifting <br /> of the easement should have no impact on adjacent properties. <br /> Planning Staff Recommendation <br /> Staff recommends approval of the easement vacation as proposed. <br />
