A house has existed on tlie lot for many years. <br /> v. No altemative location exists for a house as no part of the property <br /> is outside the 0 to 75 foot zone. <br /> vi. The new house will be properly elevated out of the floodplain. The <br /> ga.rage, laundry room and crawlspace of the existing house are <br /> below the floodplain elevation. <br /> � vii. The amount of hardcover will be reduced and partially mitigated by <br /> ' the use of permeable paving materials and lakeshore buffering. <br /> b. Approval of the conditional use permit based on: � <br /> . i. The City Engineer indicates the proposed rearrangement of the <br /> floodplain will not decrease the flood storage capacity of the <br /> � property. <br /> ii. While the grading will require the removal of a number of large <br /> trees, there is no practical alternative to elevating the driveway on <br /> fill and no � other location on the property to provide the <br /> compensatory flood storage capacity. � <br /> 4. The City Council has considered this application including the findin�s and <br /> recommendations of the Planning Cormnission, reports by City staff, <br /> comments by the appiicant and the public, and the effect of the proposed <br /> variances and conditional use permit on the health, safety and welfare of the <br /> community as well as the impact on properties in the vicinity. <br /> 5. � The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply gerierally to other property in this zoning d.istrict; that <br /> granting the variances would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owner but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property ri�ht of the Owner; and would be in keeping with the spixit and intent <br /> " of the Zoning Code and Comprehensive Plan of the City. <br /> � Page 3 of 6 <br />
