The garage is extra deep and there is a "rear closet" of about 120 square feet <br /> adjacent to the mechanical room. No finished attic space is proposed. The Commission <br /> should ask the applicant if that would be an option to provide storage space. The <br /> Commission should also consider if a single car detached garage close to Shadywood Road <br /> (which would probably require a haxdcover variance in the 250 to 500' zone) would be an <br /> appropriate substitute for the attached third gazage stall. The houses on either side have <br /> detached garages very close to Shadywood Road. Both were recently rebuilt or renovated. In <br /> 1993 structural coverage and hardcover variances were granted to allow the detached garage <br /> to the northwest to remain when the attached garage was constructed. The basis for that <br /> variance was that the basement of the house (which is probably below lake level) was <br /> unusable for storage. <br /> Issues for Consideration <br /> Does an undue hardship exist and do the variances requested provide the minimal reasonable <br /> relief? For a variance to be granted the answer must be yes. <br /> Was the plight of property owner created by the properly owner? For a variance to be <br /> granted the answer must be no. <br /> Are the variances in keeping with the spirit and intent of the zoning ordinance and with the <br /> Community Management Plan?For a variance to be granted the answer must be yes. <br /> Is the proposed house compatible with the surrounding area? For a variance to be granted the <br /> answer must be yes. <br /> Are there any other issues or concerns with this application? <br /> Staff Recommendation <br /> Planning Staff recommends approval of the lot width and area variance. Sta.ff recommends <br /> approval of a hardcover variance but only to the extent required to place a house that could <br /> be built without a hardcover variance closer to the lake. <br /> Action Required <br /> If the Planning Commission determines that no or only minor changes to the application are <br /> necessary and the applicant is amenable to making these changes, the Planning Commission <br /> should make a recommendation for approval with conditions relating to any changes. <br /> If the Planning Commission determines that major changes to the application are necessary <br /> and the applicant is amenable to making these changes, the Planning Commission should <br /> table the application. There is adequate time for the application to be considered by the City <br /> Council before the expiration of 120 days allowed by State Statute. <br /> If the Planning Commission determines that changes to the application are necessary but the <br /> applicant is not amenable to making these changes, the Planning Commission should make a <br /> recommendation for denial. The recommendation should state what is and what isn't <br /> acceptable. <br />
