FILE#16-3825 � <br /> April 18,2016 <br /> Page 2 of 2 <br /> During the final adoption of the ordinance in September 2012,there was quite a bit of <br /> discussion whether retaining walls should be included in the hardcover calculations <br /> within the lake yard. The Council at that time noted that hardcover items in the lake <br /> yard, including boat houses and sheds were `always included', although not permitted. <br /> Minutes from both the September 10 and 24, 2012 City Council meeting are attached as <br /> Exhibits C and D. <br /> Allowable hardcover, including driveways, stairways, lifts, landings and lockboxes are <br /> not among the hardcover exclusions of 78-1684. The implication is that all hardcover <br /> within the Hardcover restriction zone (aka Shore Setback Zone) is to be included in <br /> hardcover calculation. This is supported by Council's rejection of the suggestion that <br /> allowable hardcover be excluded from the hardcover calculation. (Mike Gaffron memo <br /> dated September 21, 2012, Exhibit E) and the Council's discussion that boat houses and <br /> sheds were 'always included' in the hardcover calculation. <br /> Staff Recommendation <br /> The draft ordinance codifies practice and confirms Council intent: Retaining walls are <br /> hardcover. Retaining walls are not to be included within the hardcover calculation, <br /> unless within the Shore Setback zone. Staff recommends adoption of the ordinance as <br /> drafted. <br />
