PC Exhibit A <br /> April 18, 2016 <br /> ORDINANCE NO._, THIRD SERIES <br /> CITY OF ORONO <br /> HENNEPIN COUNTY, MINNESOTA <br /> AN ORDINANCE AMENDING THE ZONING ORDINANCE PERTAINING TO THE <br /> APPROVAL PROCESS FOR SUBDIVISION EXEMPTIONS <br /> THE CITY COUNCIL OF ORONO ORDAINS: <br /> SECTION 1. Article III of Chapter 82 Subdivision Regulations shall be amended by <br /> adding the following text to read as follows: <br /> Division 5 Exemptions <br /> Sec. 82-200. - Exemptions. <br /> (1) The followin� land subdivisions are exempt from Divisions 1 throu�h 4 of this Article. <br /> Upon request,the Communitv Development Director shall, within ten davs, certify that a <br /> proposed subdivision is exempt because: <br /> a. all the resultin� parcels, tracts, lots or interests will be 20 acres or lar�er in size <br /> and 500 feet in width for residential uses and five acres or lar�er in size for <br /> commercial and industrial uses, or <br /> b. will create cemeterv lots, or <br /> c. is court ordered, or <br /> d. is an adiustment of a lot line by the relocation of a common boundarv as lon� <br /> as each of the two resultin� lots meets the requirements of Chapter 78. <br /> 1_, Adjustment of a lot line bv the relocation of a common boundarv when <br /> both resultin� lots do not meet the requirements of Chapter 78 shall be <br /> considered a Class I subdivision. <br /> (2) Procedure for exempted subdivisions. The owners of such lots to be subdivided shall file <br /> with the zonin� administrator a certificate of survev of the lots to be divided, and pav the <br /> required fee. Such certificate of survev shall show the dimensions of the lots, as measured <br /> upon the recorded plan, the area of the lots, all corner elevations, all existin� structures, <br /> includin� dimensions to existin� and proposed propertv lines, all visible encroachments, all <br /> easements of record, and their proposed division. A written description of the separately <br /> described tracts which will result from the proposed division shall be included on the survev. <br /> If the proposed subdivision complies with all of the requirements of this section, it will be <br /> approved by the Communitv Development Director and forwarded to the countv for filin�. <br /> SECTION 2.
