Within any LR-1L one-family lakeshore residential district,no structure or <br /> land shall be used for the following uses except by conditional use permit: <br /> 7) Provision of a ba.thtub or shower in an accessory building.Approval shall be conditioned on <br /> provision of municipal sanitary sewer or a conforming sewage treatment system designed to handle the <br /> anticipated flows from the building piumbing.Approval shall be granted only when the following criteria are <br /> met: <br /> a. The council finds that the proposed use of the accessory structure with a bathtub or shower <br /> will not be detrimental to the residential character of the neighborhood. <br /> b. The council fmds that the plumbing fixtures proposed are en keeping with the intended use <br /> of the accessory building. <br /> c. The accessory building is conforming in location, size and height. <br /> d. The ptoperty owner agrees to the filing of a covenant in�e title of the properiy providing <br /> that the accessory building will not be: <br /> 1. Jsed for a home occupatian unless specifically approved by the city or if allowed by <br /> this�ode. <br /> 2. Used as a dwelling unless a guest house conditional use peimit is obtained. <br /> 3. Rented, leased or otherwise provided for use as a dwelling under any circurnstances. <br /> Sec. 7�-7.���'1.-lti����-c�'�.P. Because the provision of pl�bing fixtures and wastewater plvmbing in accessory <br /> buildings has the potential to a11ow such buildings to be used as dwelling units,and because it is the policy of <br /> the city to limit residential development density to the allowed densities within the respective zoning districts, <br /> plumbiz�,g in accessory buildings sha11 be regulated as follows: <br /> (1} The provision of outside sillcocics and indoor water supply shall be allowed in any accessory building <br /> that is conforming in location, size and height. <br /> (2) Installation of any combination of fixtures rPquiring wastewater pl�bing that does not include a <br /> shower or ba#htub shall be allowed in any accessory building t1�at is conforming in location,size and <br /> height with,subject to provision of municipal sanitary sewer or a conforming sewage treatment <br /> system designed to handle the anticipated flows from such fixtures, and subject to the property <br /> owner's execvting a covenant providing that the accessory building will not be: <br /> a. Used for a home occupation unless specifically approved by the city or if allowed by this Code. <br /> b. Used as a dwelling unless a guest house conditional use permit is obtained. <br /> c. P.ented,leased or otherwise provided for use as a dwelling under any circumstances. <br /> (3) Installation of any combination of fixtures requiring wastewater plumbing that includes a shower or <br /> bathtub shall be allovved�nly in an accessory building that is confornning in location,size and height <br /> and which meets one of the following criteria: <br /> a The accessory building has been approved for a guest house conditional use permit;ar <br /> b. The accessory building has been approved for a bathtub or shower in accessory building <br /> conditional use permit. <br />
