MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD AUGUST 11, 1986 <br />#1052 JOHN T. SPENCE <br />2040 NORTH SHORE DRIVE <br />VARIANCE <br />RESOLUTION #2033 <br />John T. Spence was present for this matter. <br />Zoning Administrator Mabusth explained the request for <br />multiple variances to replace a shed and fence that were <br />damaged in an automobile accident within the past few <br />months. Applicant proposes to replace the entire fence <br />including the damaged portion of snow fence with a new <br />3 -1/2' cedar fence; and build a new shed on the existing <br />foundation. The existing foundation is approximately 6' <br />from the shared lot line of City owned property <br />requiring a side setback variance. <br />Mr. Spence stated that the proposed fence would be an <br />improvement to the existing snow fence. He stated that <br />the shed being built on,the existing foundation would be <br />less visible than if he were to rebuild it 10' from lot <br />line per original staff recommendation. <br />It was moved by Councilmember Adams, seconded by Mayor <br />Butler, to adopt Resolution #2033 approving the. <br />variances as presented. Motion, Ayes 4, Nays 0. <br />#1053 RAYMOND J. KOSAK <br />3265 CARMAN ROAD <br />CONDITIONAL USE PERMIT AND <br />AFTER -THE -FACT VARIANCES <br />RESOLUTION #2034 <br />Raymond Kosak was present for this matter. <br />Zoning Administrator Mabusth explained the after -the- <br />fact variance for new construction within the 75' <br />setback area, construction requiring a 3% hardcover <br />variance within the 75 -250' area, and hardcover variance <br />of up to 20% within the 0 -75' area. She reviewed the <br />Planning Commission's recommendation on a sketch. She <br />noted that the applicant requests the Council to re- <br />consider the Planning Commission's recommendation and <br />allow him to retain the deck area approximately 9.5 to <br />10 feet beyond the edge of the pool, rather than the 5' <br />recommended by Planning Commission. She reveiwed the <br />proposed construction of various levels of decks and <br />retaining wall. <br />Mr. Kosak explained the history and situation of his <br />property in relation to his plan. <br />Mayor Butler stated that she felt this property was <br />unique in which many levels of elevation are involved. <br />She stated that she was not sure that (per Planning <br />10 <br />
