F[L�#16-3809 �, <br /> February 16 <br /> Page 2 of 2 <br /> Building means any structure having a roof which may provide shelter or enclosure of <br /> persons,animals or chattel; and when the structure is divided by party walls without opening, <br /> each portion of such building so separated shall be deemed a separate building. <br /> Structure means anything which is built,constructed or erected, an edifice or building of any <br /> kind,or any piece of work artificially built up or composed of parts joined together.in some <br /> definite manner,which requires a location on,below or above the ground,land or water,or <br /> attached to something having a location an the ground, land or water. <br /> There is an important distinction between buildings and structures. All buildings are <br /> structures, but not a!I structures are buildings. <br /> Sport courts, pooEs, patios and hot tubs built inta the ground are common structures. <br /> Abave ground hot tubs are considered appliances and are not restrlcted to the 10 foot <br /> setback, as are grills and other simiEar features. They are restricted fio locations on a lot <br /> where a patio or deck is permissible. <br /> The proposed ordlnance would continue to provide minimum separatlon of building to <br /> building, ie. shed next to garage. <br /> S#aff recommends adoption of the ordinance as drafted. <br />
