MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,March 21, 2016 <br /> 6:30 o'clock p.m. <br /> Jabbour suggested Hennepin County be first required to demonstrate a need for additional docks and that <br /> this is the minimum number they have to have in order to respond to emergencies. <br /> Thiesse stated he would like the ordinance to include language that the dock will be secured with fence <br /> wherever possible. <br /> Jabbour stated all kinds of security should be installed to ensure the use is only for the purpose intended. <br /> Lemke stated he would like to liinit the number of docks. <br /> Barnhart noted Hennepii7 County is not proposing any slips on this dock but that three ar four boats <br /> would be able to dock there at one time. <br /> Thiesse stated his concern is that a dock could be installed at any County right-of-way. <br /> Barnhart stated the residents would benefit from the quicker response time but that Hennepin County <br /> would have to �neet certain criteria before another dock is installed. <br /> Jabbour commented there are not that many County right-of-ways in the City. <br /> Gaffron noted the City owns part of this area and that the actual access point is on City property. <br /> Barnhart stated under the ordinance a county dock has to be directly adjacent to a county right-of-way and <br /> that there is no non-right-of-way land on the lakeside of County Road 15 in this area. Barnhart stated he <br /> has not done a full analysis throughout the City to determine where a county right-of-way is adjacent to <br /> the lake but that in his cursory view, the City does not have that many. <br /> Schoenzeit stated language could be added that all additional dock locations will be built with a variance <br /> request. <br /> Barnhart noted the City cannot grant a variance for a use. The ordinance states that it is a permitted use in <br /> that zone and also includes a number of other criteria. The ordinance requires that the dock be owned and <br /> operated by Hennepin County and be adjacent to a Hennepin County right-of-way, with its sole purpose <br /> being for access. Barnhart stated all those conditions are an attempt to limit the number of docks. <br /> Leskinen asked if this dock and any other dock would need to be approved by the LMCD. <br /> Jabbour stated it would need to be. <br /> Barnhart indicated Staff included that language in the ardinance as a safeguard. Barnhart stated assuming <br /> it meets all of the LMCD's criteria, it would go tl�rough the City's approval process. <br /> Chair Leskinen closed the public hearing at 8:45 p.m. <br /> Schoenzeit moved, Olson seconded,to recommend approval of Application No. 16-3816, Cit,y of <br /> Orono,Zoning Code Amendment Pertaining to Docks for Emergency Access,with the condition <br /> that the dock be secured b,y fencing and a locked gate.
