MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Tuesday,February 16,2016 <br /> 6:30 dclock p.m. <br /> Staff recommends approval of the ordinance. <br /> Chair Leskinen opened the public hearing at 9:54 p.m. <br /> There were no public comments regarding this application. <br /> Chair Leskinen closed the public hearing at 9:54 p.m. <br /> Leskinen commented the ordinance is pretty straight forward. <br /> Thiesse stated he is unsure what integral means. <br /> Barnhart stated a patio or a driveway would be considered a structure which is integral to the house. <br /> Those features are allowed to be within ten feet of the principal structure. <br /> Schoenzeit asked if the City has ever considered requiring frost footings on detached garages. <br /> Barnhart stated it cannot be more restrictive than the Building Code. <br /> Curtis stated as it relates to the structure that is integral to the principal building, it would be something <br /> that is not physically attached to a home. <br /> McGrann moved,Thiesse seconded, to recommend approval of Application No. 16-3809,City of <br /> Orono,Text Amendment: Accessory Structure Setbacks, per staff recommendation. <br /> Schoenzeit stated usually text amendments are word changes and that he is a little uncomfortable with the <br /> Planning Commission getting new text amendments at the Planning Commission meeting. Schoenzeit <br /> stated he would like to see the proposed text amendments at a work session. Schoenzeit noted lighting is <br /> clearly not a text amendment and will be discussed at a work session and that in his view a text <br /> amendment means a housecleaning amendment. Schoenzeit stated he is not sure the Planning <br /> Commission should see them for the first time at a Planning Commission meeting. <br /> Curtis stated this text amendment is pretty straight forward. <br /> Barnhart stated Staff felt this was a fairly simple text amendment and that the Planning Commission <br /> could table it if they are not comfortable with it. Barnhart indicated Staff will make it a point to introduce <br /> major text amendments at work sessions. <br /> VOTE: Ayes 6,Nays 0. <br /> 9. #16-3810 CITY OF ORONO TEXT AMENDMENT: PUBLIC NOTICE <br /> REQUIREMENTS ASSOCIATED WITH PUBLIC HEARINGS,9:56 P.M.- 10:13 P.M. <br /> Barnhart noted the City Council and the Planning Commission at their November ordinance review <br /> meeting felt there was some confusion with Section 78-98. It was felt that Section 78-98 suggests a six- <br /> month window to acquire land. There was also a question relating to the notice of 350 feet for a <br /> conditional use permit and 150 feet for variance and that those two should be consistent. <br /> Page 27 of 30 <br />
