MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Tuesday,February 16,2016 <br /> 6:30 o'clock p.m. <br /> Schoenzeit stated if they start at 4 a.m. in the morning,that is not code compliant. <br /> Leskinen stated she is not sure if the City should just go out and start checking and that it can be <br /> addressed at the time a complaint is received. <br /> Schoenzeit stated the letter is notice to the developer. <br /> Landgraver commented he is not sure the City can compel a home purchaser to certify that they have <br /> received the letter. <br /> Schoenzeit stated the letter or notice to the developer does not give them the right to break the ordinances <br /> even if that is what they have been doing over the years. <br /> Leskinen stated the properly owners will need to understand what is there. <br /> Thiesse stated the City has the right to stop activities that are outside of the law and that property owners <br /> have the right to complain if something becomes a problem. <br /> Schoenzeit stated this type of letter is trying to give notice to the future property owners. <br /> Lemke indicated he is in agreement with Commissioner Schoenzeit. <br /> Lemke asked if the temporary cul-de-sacs meet code. <br /> Gaffron stated in the past the temporary cul-de-sacs end up with an easement over the properties at the <br /> corners. At the point those cul-de-sacs are no longer needed, they would then be vacated, removed, and <br /> the easements vacated. <br /> Lemke asked if they are big enough to turn around. <br /> Gaffron indicated they are. <br /> Lemke asked if the length exceeds the City's maximum. <br /> Gaffron stated one of the reasons for the two access points onto Old Crystal Bay Road was because <br /> without them, the cul-de-sacs would exceed the 1,000 foot limit. At this point they do not. <br /> Lemke asked whether two accesses onto Old Crystal Bay Road would be allowed. <br /> Gaffron noted Old Crystal Bay Road is a city-owned road and that the City will allow it. The access <br /> points would be required to be placed across from the Orono Industrial Park access points. <br /> McGrann noted traffic by the school is fairly heavy at times. McGrann asked whether Staff has any <br /> thoughts about the increased traffic and the impact from this development. <br /> Gaffron indicated he asked the City Engineer if there is a need for turn lanes,which gets to the question <br /> of whether there should be sidewalk access for pedestrians at the corner. Gaffron stated there needs to be <br /> the ability to walk across the road with the light and that there should be four-way crosswalks so people <br /> can cross at each corner. <br /> Page 13 of 30 <br />
