Memorandum �Bonestroo <br /> To: MelanieCurtis Project: 3382BaysideDrive Date: 10/19/09 2335Highway36W <br /> St.Paul,MN 55113 <br /> From: John Smyth Client: City or Orono Te1651-636-4600 <br /> Fax651-636-1311 <br /> Re: Wetland Buffer Ordinance File No: 139-09000 www.bonestroo.com <br /> Remarks: <br /> This project involves the construction of a new home at 3382 Bayside Drive. Due to it being a <br /> new structure with grading the proposed project is subject to the City Wetland Ordinance. Per <br /> the filled out MNRAM provided by the applicant this wetland is classified as a Manage 3 basin <br /> which requires a 16.5 foot buffer and 20 foot setback from the buffer. <br /> Buffer Condition and Requirements <br /> A site evaluation was completed in October 2009 and it was determined that a portion of the <br /> buffer is currently turf grass and contains buckthorn. Per Div.3 Sec.78-1605(2)(a)turf grass <br /> and buckthorn is considered an undesirable plant species and will need to be removed and <br /> replaced with native vegetation. The applicant has submitted a proposed landscaping plan. <br /> With some additional information the landscape plan should meet the requirements ofthe <br /> Wetland Ordinance. <br /> The additional information required includes: <br /> 1. Quantities and size of the plants to be installed <br /> 2. The applicant proposes to maintain the buckthorn hedge within the buffer. Buckthorn <br /> is an invasive species that is considered undesirable and is specifically listed as a . <br /> species to be removed if within the buffer.There is only a small portion of the hedge <br /> within the required 16.5 foot buffer and it is recommended to replace this <br /> portion of the hedge with other species so it is in compliance with the ordinance. <br /> 3. A schedule of activities that are part of the management and maintenance(mowing <br /> invasive weeds,spot herbicide treatment of invasives,etc.)for the establishment of <br /> vegetation in the buffer shall be provided. <br /> Survey Requirements <br /> The current survey shows an area of native seeding but does not depict the wetland delineation <br /> or a line that is labeled as the buffer. The location of the wetland boundary and buffer will need <br /> to be shown on the survey along with a legal description for the upslope edge of the buffer <br /> which is required to be submitted with the Restrictions and Covenants. <br /> Restriction and Covenant for Wetland and Buffer <br /> Per Section 78-1611 of the wetland ordinance the owner shall record Restriction and Covenants <br /> over the wetland and buffer with the property chain of title. A form with the language for the <br /> Restriction and Covenants is available from the City. <br />
