PC Exhibit D <br /> � O� <br /> O O <br /> � CITY of ORONO <br /> 9 <br /> � '• i. � <br /> � , <br /> �',�� � �G'�' RESOLUTION OF T5 6 6 4COUNCIL <br /> � `�kEsKO4 NO. � <br /> A RESOLUTION GRANTING A VARIANCE <br /> TO MU1vICIPAL ZONING CODE <br /> SECTION 78-330 <br /> FILE NO. 06-3191 <br /> WHEREAS, Mark James Fuller, Stacey Michelle Nakaya, and Karen <br /> Lynn Feyo (hereinafter"Owners") are the owners of the property located at 4055 Elm Street <br /> within the City of Orono (hereinafter "City") and legally described as: Lots 7, 8 and 9, Block <br /> 9,Minnetonka Summit Park Hennepin County, Minnesota(hereinafter"the Property"); and <br /> WHEREAS, the Owners have made application to the City for a variance to <br /> Municipal Zoning Code Section 78-330 to allow construction of a new house on a lot that is <br /> 0.44 acre in area and 120 feet wide when an area of 1.0 acre and a width of 140 feet are <br /> required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on June 18, 2007, at which times all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#06-3191. <br /> 2. The property is located in the LR-1B zoning district, where 1 acre is the <br /> minimum lot area and 140 feet is the minimum lot width. The property is <br /> approximately 0.44 acre in area and 120 feet in width. <br /> 3. The Planning Commission reviewed this application on June 18, 2007 and on a <br /> vote of 5 - 0 recommended approval of the variance, based on the following <br /> . findings: <br /> a.
