, � �O� . , � 3 � � � �� <br /> � C ITY OF ORONO <br /> RESOLUTION OF THE CIT'Y COUNCIL <br /> ��, � �j � ��. � <br /> G N O. `� � <br /> j�kESH��� <br /> A RESOLUTION <br /> GRANTING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 78-1288, 78-1680 8� 78-1700 <br /> FILE NO. 15-3778 <br /> WHEREAS, Todd Michael Balan, a singie person (hereinafter"the Owne�") is the <br /> owner of the property located at 2905 Casco Point Road within the City of Orono (hereinafter <br /> the "City") and legally described as: Lot 98 and 109; also that part of vacated Lake Shore <br /> Avenue, and that part of the tract of land between said vacated Avenue and the shore of <br /> Lake Minnetonka, lying between extension across if of the side lines of said Lot 98, all in <br /> Spring Park, Hennepin County, Minnesota (Certificate of Title No. 1386168) (hereinafter the <br /> "Property"); and <br /> WHEREAS, the Owner has made application to the City of Orono for variances to <br /> Orono Municipal Zoning Code Sections 78-1288, 78-1680 and 78-1700 to allow construction of a <br /> new detached garage partially over existing hardcover resulting in 29.79% hardcover where <br /> 29.79% exists and 25% hardcover is permitted; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the Orono <br /> Planning Commission on September 21, 2015 at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File number 15-3778. <br /> 2. The Property is located in the LR-1 C One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 0.5 acres and a minimum lot width of <br /> 100'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> September 21, 2015 and voted 6 for and 0 against on a motion to approve the <br /> conditional use permit and variance.
