The applicants have proposed to remove minimal amounts of what exists in <br /> conjunction with their proposal. They have proposed a 64 s.f. reduction within the 0-75' zone <br /> and 97 s.f. within the 75' —250' zone. � <br /> Furthermore, the deck where the proposed porch addition is to be constructed is the subject <br /> of Exhibit F. It was constructed illegally in 1988. The City notified the applicants that permits <br /> and hardcover variance approvals were required, there was a great deal of communication <br /> back and forth, and a citation was issued but the issue of the lack of approval has not been <br /> resolved. <br /> Side Yard Setback Variances <br /> Neither the two-story living space addition nor porch addition meet the required 10' side <br /> setback requirement on their respective sides of the home. The porch is proposed to be set <br /> back 6.4' from the western side lot line and the living space addition is proposed at a 0' <br /> setback from the eastern side lot line, which is also the municipal boundary between the two <br /> cities. <br /> Hardship Statement <br /> Applicant has completed the Hardship Documentation Form attached as Exhibit B, and <br /> should be asked for additional testimony regarding the application. <br /> Hardship Analysis <br /> In considering applications for variance, the Planning Commission shall consider the <br /> effect of the proposed variance upon the health, safety and welfare of the community, <br /> exisfing and anticipated traffic conditions, light and air, danger of fire, risk to the <br /> public safety, and the effect on values of property in fhe surrounding area. The <br /> Planning Commission shall consider recommending approval for.variances from the <br /> literal provisions of the Zoning Code in instances where their strict enforcement would <br /> cause undue hardship because of circumstances unique to fhe individual property <br /> under consideration, and shall recommend approval only when it is demonstrated that <br /> such actions will be in keeping with the spirit and intent of the Orono Zoning Code. <br />
