ORONO CITY COUNCIL MEETING <br />MINUTES FOR OCTOBER 25, 1999 <br />( #9 Request for Dock Access, Continued) • <br />will be approved for access to any one property. City Staff is looking for direction from the City <br />Council on development of a dock policy relating to inland lots on Big Island without lake access. <br />The Code states that these issued permits are to be valid for one year and shall be subject to <br />change, alteration or revocation for cause by the City Council at any time, and shall be <br />automatically renewable on the anniversary of the date except upon written notice from the City <br />to the permittee at least 30 days prior to the anniversary date. <br />Weinberger stated that any formal requests for permits on Big Island do require a public hearing <br />with the Planning Commission or the City Council and notice to all adjacent property owners <br />within 350 feet. <br />Weinberger remarked that the issues for the City Council to discuss tonight include whether <br />dock rights should be for other property owners without any other access. Some of the parcels <br />on Big Island are held in common ownership but are not combined for tax purposes into one tax <br />parcel. Potentially the individual lots could be sold to several owners that may request access in <br />the future. The permit approved by the City Council per Resolution No. 2038 permitted a dock <br />in favor of property located at 230 Big Island. A condition of approval was any other requests <br />for docking at the Bay Place site would cause the permit to be revoked immediately. <br />Lovelace stated he understands the concerns of the City Council, noting that there is currently a • <br />dock access that has been granted by the City. <br />Mayor Jabbour commented that that dock access would need to be revoked if a new dock access <br />is granted. <br />Lovelace stated that he would not object to sharing this boat access with the adjoining property <br />owners. <br />Mayor Jabbour stated that according to LMCD code, the dock must be located 25 feet from the <br />property line. <br />Sansevere inquired how many boats could be accommodated on that 90 foot parcel. <br />Mayor Jabbour stated that a minimum of six boats, which should take care of the landlocked parcels. <br />Jabbour stated the general public has access to the lake through City- oNNned docks and that the <br />City Council should recognize the present laws governing docks. <br />Lovelace stated he was aware at the time he purchased this property that the land was <br />landlocked and that the City has an ordinance allowing the landowner to request dock access. <br />Lovelace stated he is requesting a permit to allow the dock access, and that an option would be <br />to share dock access with the adjoining neighbors. • <br />Page 8 <br />
