ORONO CITY COUNCIL MEETING <br />MINUTES FOR SEPTEMBER 27, 1999 <br />I] <br />*( #4) #2510 DOUGLAS AND CLAUDIA WHITELEY/DAVID AND HEIDI HUST, <br />60 ORONO ORCHARD ROAD SOUTH AND 45 SMITH AVENUE - CLASS 1 SUBDIVISION <br />OF A LOT LINE REARRANGEMENT - RESOLUTION NO. 4352 <br />Kelley moved, Peterson seconded, to approve and adopt RESOLUTION NO. 4352, <br />a Resolution Approving a Subdivision of a Lot Line Rearrangement for Properties <br />Located at 60 Orono Orchard Road South and 45 Smith Avenue. <br />VOTE: Ayes 5, Nays 0. <br />( #5) #2516 JEFF MARTINEAU, 1420 SHORELINE DRIVE - VARIANCES AND <br />REQUEST FOR SEWER UNIT - RESOLUTION NO. 4353 <br />Jeff Martineau, Applicant, was present. <br />Weinberger stated the Applicant is requesting variances to allow the lot to be redeveloped <br />as a residential site and to permit the detached garage on the property to remain. City Code <br />does not allow an accessory building to remain after the principal building has been removed <br />without the Council granting a variance. The Applicant is also requesting variances from bluff <br />setback to permit a new residence to be constructed within the 30 feet bluff setback. The <br />Applicant is proposing to construct a new residence 20 feet into the bluff setback. • <br />Weinberger stated the property owners have considered other possible building sites for the <br />new residence, but due to the fact that this property abuts County Road 15, placement of the <br />residence out of the bluff setback would place the structure within the 50 foot street setback. <br />The Planning Commission, on a 4 to 2 vote, recommended approval of the bluff setback <br />variance and average lakeshore setback variances to permit construction of a new residence <br />on the property. <br />Weinberger indicated that the previous residence was removed in 1997, with a garage located <br />within the 0 -75' lakeshore setback remaining on the property. According to City Codes, accessory <br />structures are not permitted on the property without a principal structure. The Applicant is <br />requesting variances to allow the garage to remain in its present location. <br />The Planning Commission, on a 4 to 2 vote, recommended denial of variances to allow the <br />existing garage to remain within the 0 -75' lakeshore setback. The Planning Commission <br />recommended removal or relocation of the garage out of the 0 -75' lakeshore setback. <br />Weinberger stated that this area is tentatively scheduled to be included in MUSA next year, with <br />the Planning Commission recommending that one sewer unit be made available to this property. <br />Martineau stated a letter from Steve Schirmers was received which indicates that it is difficult to <br />locate two viable septic sites on this property, noting that City Staff is recommending approval <br />of the connection to City sewer for this property. • <br />5 <br />
