w, ✓ <br /> 3 I <br /> 0 0 <br /> 0 <br /> =- .. to- _ CITY of ORONO <br /> lk� i;�;t ��, RESOLUTION OF THE CITY COUNCIL <br /> -kESIiOg' NO. 3142 <br /> A RESOLUTION GRANTING <br /> VARIANCES TO MUNICIPAL ZONING CODE <br /> SECTION 10.22, SUBDIVISION 1 (B) AND SUBDIVISION 2 <br /> FILE #1752 <br /> WHEREAS, George W. Kalweit and Katherine M. Kalweit <br /> (hereinafter "the applicants") are owners of the property located <br /> at 4265 Forest Lake Drive within the City of Orono (hereinafter <br /> "City") and legally described as follows: <br /> Lot 8, Block 2, Forest Arms, Hennepin County, Minnesota <br /> (hereinafter "the property"); and <br /> WHEREAS, the applicants have applied to the City for <br /> after-the-fact variances to Municipal Zoning Code Section 10.22, <br /> Subdivision 1 (B) and Subdivision 2 to permit major structural <br /> repair to an existing deck located 69 feet from the shoreline <br /> instead of the required 75 feet and seek approval of a hardcover <br /> variance within the 0-75 foot setback area where no hardcover is <br /> allowed. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #1752. <br /> 2. The property is located in the LR-1B, Single Family <br /> Lakeshore Residential Zoning District requiring 1 acre <br /> in area and the property consists of .86 acres. <br /> 3. The Orono Planning Commission reviewed this application <br /> on July 20 , 1992, and recommended approval of the <br /> proposed after-the-fact variances based upon the <br /> following findings: <br /> A. The home was built in 1970 prior to the current <br /> lakeshore development ordinances adopted in 1973- <br /> 1975. <br /> B. The deck is in a hazardous condition requiring <br /> major structural repairs. <br /> Page 1 of 4 <br />
