The major structural repair of deck did not <br /> involve an expansion from the existing building <br /> envelope. <br /> C. The lots on Casco Cove are located on a curved <br /> portion of shoreline and the slight encroachment <br /> of the average setback line has no real impact on <br /> the views from the adjacent residences. <br /> D. The City has received a letter approving the <br /> reconstruction of the deck from the neighbor <br /> receiving the most impact from the existing deck. <br /> 4. The City Council finds that the conditions existing on <br /> this property are peculiar to it and do not apply <br /> generally to other property in this zoning district; <br /> that granting the variance would not adversely affect <br /> traffic conditions, light, air nor pose a fire hazard <br /> or- other danger to neighboring property; would not <br /> merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or <br /> difficulty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in <br /> keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application <br /> including the findings and recommendations of the <br /> Planning Commission, reports by City staff, comments by <br /> the applicant and the effect of the variances on the <br /> health, safety and welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono <br /> City Council hereby grants variances to Municipal Zoning Code <br /> Sections 10.22, Subdivision 1 (B), Section 10.22, Subdivision 2 <br /> and Section 10.25, Subdivision 6 (B) that will approve the major <br /> structural repairs to an existing deck located l' 3" in front of <br /> an average lakeshore setback, improvements to a structure where <br /> excesses of hardcover exist within the 75-250' setback area at <br /> 5,046 s.f. or 45.6% and where the deck is located 9' instead of <br /> the required 10' from the north side lot line. This approval is <br /> subject to the following conditions: <br /> Page 2 of 4 <br />
