BAYSIDE ADDITION TO LARE MINNETONRA <br /> WH$R$AS, the City of Orono is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; <br /> and <br /> WH$REAS, the Stubbs Bay Sewer Project was initiated by <br /> the City to solve existing on-site sewage treatment problems in <br /> the Stubbs Bay area, within which Lots 17 and 18, Block 5, <br /> Bayside Addition to Lake Minnetonka, are located; and <br /> WHEREAS, the aforementioned Lots 17 and 18 are legal ly <br /> combined for tax purposes into a single parcel, legally described <br /> as: PIN number 05-117-23 14 0042; and <br /> • WHEREAS, said parcel is under single separate ownership <br /> not owned in common with any other abutting or nearby properties; <br /> and . <br /> WH$REAS, al 1 adjacent lots are occupied; and <br /> WH$REAS, said parcel is located within the LR-lA Single <br /> Family Lakeshore Residential Zoning District, requiring 2.0 acres <br /> per buildable site; and <br /> WHEREAS, the total dry land area of the parcel is <br /> approximately 0.29 acres, not meeting the 2.0 acre requirement; <br /> and <br /> WH$REAS, said parcel is not buildable without one or <br /> more variances from the existing zoning code; and <br /> WHEREAS, construction of a single family residence on <br /> the parcel if done according to all zoning performance standards <br /> would be contrary to the intent of the Community Management Plan; <br /> and <br /> WH$RSAS, failure to provide sewer ,service would make <br /> the parcel unbuildable because of insufficient room to provide <br /> • for house, well , and primary and future septic system <br /> drainfields; and <br /> Page�, 1 of 2 <br />
