. • �� . <br /> � O� ' <br /> • O O <br /> - �b. - CITY of ORONO <br /> � � � <br /> ti <br /> ��� �G'�' RESOLUTION OF THE CITY COUNCIL <br /> �kESH�� NO. 318 2 <br /> CONCLIISIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono <br /> City Council hereby grants a conditional use permit per Municipal <br /> Zoning Code Section 10.03, Subdivision 10 and a variance to <br /> Section 10.03, Subdivision 9 (E) that would approve an accessory <br /> structure to be placed in the street rear yard of the property <br /> that will conform to al1 required setbacks except to the north <br /> side lot line to be located 13' instead of the required 15' , <br /> subject to the fol lowing conditions: <br /> l. Upon application for a building permit, applicant shall <br /> provide an updated survey locating detached structure <br /> at 25' x 36' located 35' from rear street yard, 15' <br /> from south lot line and 13' from north side lot line. <br /> 2. Applicant must obtain a demolition permit for the <br /> removal of the existing accessory structure. <br /> • 3. Authorities granted by this resolution run with the <br /> property not with the applicant, but are permissive <br /> only and must be exercised by application for a <br /> building permit within one year of the date of Council <br /> approval, or this variance/conditional use permit will <br /> expire on that date (September 28, 1993). <br /> 4. Violation of or non-compliance with any of the terms <br /> � and conditions of this resolution shall constitute a <br /> violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be <br /> punishable as a misdemeanor. <br /> 5. The undersigned applicant has read, understood and <br /> hereby agrees to the terms of this resolution and on <br /> behalf of himself, his heirs, successors and assigns, <br /> hereby agrees to the recording of this resolution in <br /> the chain of title of the property. , <br /> Page 3 of 5 <br /> • . <br />
