. • �� . � O� ' • O O - �b. - CITY of ORONO � � � ti �� G'�' RESOLUTION OF THE CITY COUNCIL �kESH�� NO. 318 2 CONCLIISIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a conditional use permit per Municipal Zoning Code Section 10.03, Subdivision 10 and a variance to Section 10.03, Subdivision 9 (E) that would approve an accessory structure to be placed in the street rear yard of the property that will conform to al1 required setbacks except to the north side lot line to be located 13' instead of the required 15' , subject to the fol lowing conditions: l. Upon application for a building permit, applicant shall provide an updated survey locating detached structure at 25' x 36' located 35' from rear street yard, 15' from south lot line and 13' from north side lot line. 2. Applicant must obtain a demolition permit for the removal of the existing accessory structure. • 3. Authorities granted by this resolution run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance/conditional use permit will expire on that date (September 28, 1993). 4. Violation of or non-compliance with any of the terms � and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property. , Page 3 of 5 • .
