( � . � <br /> � O� <br /> • O O <br /> �b� - CITY of ORONO <br /> � � <br /> ti <br /> ��� �G'�' RESOWTION OF THE CITY COUNCIL <br /> �kESHOg' NO. 318 6 <br /> 6. e City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to <br /> other property in this zoning district; that granting the <br /> variance would not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other danger to <br /> neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate <br /> a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicant; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. , <br /> CONCLOSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoning Code Sections 10.22, Subdivisions <br /> 1 and 2; 10.55, Subdivision 8; and 10.56, Subdivision 16 (L) , to <br /> permit the construction of additions to the existing residence which <br /> • result in hardcover in the 0-75' lakeshore setback zone of 7.2� where <br /> no hardcover is normally allowed, 40.5� hardcover in 75-250' setback <br /> zone where only 25� hardcover is normally allowed, and structural <br /> encroachment in the 0-75' zone yielding a structure setback of 60' <br /> from the shoreline where a 75' setback is normally required and no <br /> structure is �normally allowed, subject to the following conditions: <br /> 1. Applicant shall adhere to the "Plan D" grading plan (Exhibit <br /> "B" attached) and shall adhere to any modifications <br /> of the P lan as recommended by the City Engineer now .or in <br /> the future to prevent or eliminate erosion problems. <br /> 2. Hardcover in the 0-75' zone is approved at a level of 7.2$. <br /> Hardcover in the 75-250' zone is approved at a level of <br /> 40.5�. Hardcover in the 250-500' zone is approved at 23.3�. <br /> A 1 1 existing and proposed hardcover approved with this <br /> variance approval is recorded in the calculation worksheet <br /> and diagram included in Exhibit "B". The current property <br /> owner and all future owners of this property are placed on <br /> � notice that hardcover shall not be increased above the <br /> currently approved level and any proposed improvements of <br /> this �property that will result in additional hardcover must <br /> be approved by the City.
