• <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3065 <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 (B) <br />FILE #1705 <br />WHEREAS, Christopher J. Smith (hereinafter "the applicant") <br />is the owner of the property located at 3650 Casco Avenue within the <br />City of Orono (hereinafter "City") and legally described as follows: <br />Tract A, R.L.S. No. 1147, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.22, Subdivision 1 (B) to <br />permit the construction of a new residence to be constructed in front <br />of the average lakeshore setback line where no encroachment is <br />allowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1705. <br />2. The property is located in the LR -1C Lakeshore Residential <br />Zoning District requiring a 1/2 acre or 21,780 s.f. in area. <br />The property consists of 38,060 s.f. or .87 acres. <br />3. The Orono Planning Commission reviewed this application on <br />January 21, 1992 and recommended approval of the proposed <br />variance based upon the following findings: <br />a) The lot to the immediate south has a platted corridor <br />to the lakeshore at an approximate 50 foot width and is <br />classified as a riparian lot subject to average <br />lakeshore setback standards. <br />b) If the average lakeshore setback line standard was to <br />be upheld, the lot would be technically unbuildable. <br />• Page 1 of 5 <br />
