Comments from Department of Natural Resources received January 14, 2009 <br /> Background <br /> .Within the Wayzata Country Club a major drainage ditch flows from north to south from the <br /> Luce Line to north of tennis courts. This ditch drains about 25 acres north of the Luce Line <br /> plus most of the country club's property south of the Luce line and east of Old Long Lake <br /> Road. It is piped under Wayzata Boulevard. Eventually it flows to Peavey Lake and Lake <br /> Minnetonka. The ditch is classified as a wetland. <br /> Proposal <br /> � Please refer John Smyth's report (Exhibit D) regarding the wetland alteration. <br /> Excavated material will be retained on-site to create berms up to five feet high. Two would <br /> be along the south side of the Luce Line Trail east of the ditch and three in the area east of <br /> � the ditch between the two fairways. � <br /> The project requires approval from the Minnehaha Creek Watershed District. As part of the <br /> � permitting process the impact of the pond on the storm drain system will be evaluated. <br /> Issues for Consideration <br /> The proposed berms should have virtually no impact on adjacent residential areas. <br /> Are there any issues or concerns with this application? <br /> � ' Staff Recommendation <br /> Planning Staff recommends approval of the conditional use permit for wetland alteration and <br /> land alteration subject to the following conditions: <br /> 1. Provision of a flowage and conservation easement and restrictive covenant over the <br /> wetlands and wetland buffers. <br /> 2. Provision of a $6,000 escrow and an escrow agreement agreement to guarantee <br /> establishment of the buffers. <br /> 3. Issuance of a permit or conditional approval of a permit by the Minnehaha Creek <br /> Watershed District. <br />
