AV <br />ESTI <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3054 <br />A RESOLUTION VACATING <br />AN UNDEVELOPED PORTION OF CLARA AVENUE <br />WITHIN THE PLAT OF LOMA LINDA, <br />(SECTION 8, TOWNSHIP 117, RANGE 23) <br />HENNEPIN COUNTY, CITY OF ORONO, MINNESOTA <br />FILE NO. 1703 <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, on October 28, 1991, Edwin J. Gibbs and Tracee Gibbs <br />filed a petition with the City of Orono requesting the vacation of portions <br />of an unimproved right-of-way known as Clara Avenue originally dedicated in <br />the plat of Loma Linda and legally described as follows: <br />That part of the 20' wide Clara Avenue as dedicated in the Plat <br />of Loma Linda, Hennepin County, Minnesota, which lies south of <br />the westerly extension of the north line of Lot 31, Loma Linda <br />and which lies north of the westerly extension of the north line <br />of the south 15' of Lot 20, Loma Linda (Section 8, Township 117, <br />Range 23), Hennepin County, Minnesota; and <br />WHEREAS, after due published and posted notice, a public hearing <br />was held before the Planning Commission on November 18, 1991, regarding <br />said vacation and all interested persons were given an opportunity to be <br />heard; and <br />WHEREAS, after due standing and consideration, the Planning <br />Commission voted to recommend approval of the requested vacation and- the <br />Council of the City of Orono finds that said vacation, as proposed, is in <br />keeping with the public interest and consideration of the following <br />findings: <br />1. Existing 20' width of right-of-way would not meet current <br />standards for development of a public road. <br />2. Based on the pattern of development within the Loma Linda plat, <br />there is no need for a right-of-way for access purposes. <br />0 <br />Page 1 of 2 <br />
