CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3033 <br />A RESOLUTION AMENDING <br />RESOLUTION NO. 2960, <br />FILE NO. 1626 <br />WHEREAS, Eric and Kristal Wilson (hereinafter "the <br />applicants") are owners of the property located at 2683 North Shore <br />Drive within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Tract B, Registered Land Survey No. 1373, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, on May 13, 1991 the City Council of the City of <br />Orono granted variances to Municipal Zoning Code Section 10.23, <br />Subdivision 6 (B) for lot area, lot width and side yard setback to the <br />previous owners, Tim and Beth Traff, for a new residence, portions of <br />which were to be constructed 24.5' from the east side lot line where a <br />• 30' setback is normally required; and <br />WHEREAS, the applicants have proposed a different house and <br />different site plan than that approved for Mr. and Mrs. Traff; and <br />WHEREAS, on October 21, 1991 the Orono Planning Commission <br />reviewed the site plan attached to this resolution as Exhibit A, and <br />recommended approval of the revised proposal on a vote of 4 to 2; and <br />WHEREAS, the revised proposal locates portions of the <br />proposed garage and house as near as 27' to the east side lot line, <br />but proposes the equivalent square footage of footprint encroachment <br />of the 30' required side yard as was approved with the Traff variance <br />request; and <br />WHEREAS, the City Council finds that this proposed <br />structure/site plan meets with the original intent of the approval <br />granted in Resolution No. 2960. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />Page 1 of 4 <br />
