CITY,of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />3016 <br />A RESOLUTION GRANTING <br />A VARIANCE TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 9 (D) <br />FILE #1673 <br />WHEREAS, Daniel J. Kluth (hereinafter "the applicant") <br />is the owner of the property located at 2801 Fox Street within <br />the City of Orono (hereinafter "City") and legally described as <br />Lot 1, Block 3, Farview, Hennepin County, Minnesota (hereinafter <br />"'the property") ; and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.03, Subdivision 9 <br />(D) to permit a detached garage to be located in front of the <br />front lire of the principal structure located 100' from the <br />street lot line where the existing principal structure is located <br />116' 6". <br />• <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1673. <br />2. The property is located in the LR-lA Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on August 19, 1991 and recommended approval of the <br />proposed variance based upon the following findings: <br />a. House has been placed to the extreme rear of the <br />lot. <br />b: House has been placed at an angle to the front <br />street setback line. <br />C. To locate garage either behind the front street <br />setback line of the house or to the south end of <br />the driveway would require the removal of dense <br />foilage and a mature black walnut tree. <br />d. The garage will be shielded by mature vegetation <br />in the proposed location to both the west and <br />• south lot lines. <br />Page 1 of 4 <br />
