N0. �28�1 <br /> •'- • • <br /> -;},� ;��, <br /> � A RESOLIITION GRANTING � <br /> A VARIANCE TO <br /> � M[JNICIPAL ZONING COD$ <br /> SECTION 10.28, SIIBDNISION 5 (B) <br /> FILE 1578 <br /> WHEREAS, A1 and Libbie Hopwood (hereinafter "the <br /> applicants" ) are owners of the property located at 1205 Lakeview <br /> Avenue within the City of Orono (hereinafter "City") and legally <br /> described as follows: <br /> Lots 12 and 13, Block l, Maxwell's Addition to Crystal Bay, Lake <br /> Minnetonka , Hennepin County, Minnesota (hereinafter "the <br /> property"); and <br /> WH$REAS, the applicants have applied to the City for a <br /> variance to Municipal Zoning Code Section 10.28, Subdivision 5 (B) to <br /> permit the construction of a deck to be located 27' from the street <br /> lot line and 23' from the side street lot line where a 50' setback is <br /> ,� required from both lot lines. • � .;' <br /> . , <br /> NOW, THEREFORE, BE IT RESOLVED by the City Counci T�of Orono, <br /> Minnesota: � <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File 1578. <br /> 2. The property is located in the RR-1B Single Family Rural <br /> Residential Zoning District. <br /> 3. The Orono Planning Commission reviewed this application on <br /> August 20, 1990, and on a vote of 5 to 0 recommended approval of <br /> the proposed variance based upon the following findings: <br /> a) The orientation of the house on this corner lot and the <br /> size of the lot . are hardships to the property which would <br /> limit construction within the area of the house proposed for <br /> the deck. <br /> b) No neighboring properties will be impacted by <br /> construction of the proposed deck with railing and lattice <br /> work below extending to grade. <br /> Page 1 of 4 <br /> . <br />
