' RESOLUTION OF THE CITY COUNCIL <br /> y� <br /> �" � NO. 2859 <br /> • - • • <br /> �,.y. <br /> A RESOLIITION VACATING <br /> DNQS$D PORTIONS OF <br /> DRAINAG$ AND IITILITY EASEMENTS <br /> � WITHIN TH$ PLAT OF McHANEY ADDITION, <br /> HENNEPIN COIINTY, CITY OF ORONO, MN <br /> FII.$ NO. 1571 <br /> WHEREAS, the City of 0'rono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHER$AS, on July 16 , 1990, JoAnn M. Grimes and James Hoffman <br /> filed a petition with the City of Orono requesting the vacation of certain <br /> poritons of drainage and utility easements orginally dedicated in the plat <br /> of McHaney Addition, such portions of easements legally described as <br /> follows: <br /> The 5.00' wide utility and drainage easements on each side of the <br /> lot line between I,ots 1 and 2, Block l, McHaney Addition as <br /> dedicated on the recorded plat thereof; said easements to be <br /> • vacated do not include any portion of the 10.00' wide utility and <br /> drainage easements surrounding the perimeter of said plat in <br /> Hennepin County, Minnesota; and <br /> � <br /> WHERl3AS, after due published and posted notice, a public hearing <br /> was held before the Orono Planning Commission on August 20, 1990, regarding <br /> said vacation and all persons interested were given an opportunity to be <br /> heard; and <br /> WHEREAS, after due standing and consideration, the Planning <br /> Commission recommended approval of the requested easement vacation and the <br /> Council of the City of Orono finds that said vacation, as proposed, is in <br /> keeping with the public interest in consideration of the following <br /> findings: <br /> 1. Easement vacation does not affect existing or proposed utilities <br /> on either of the affected properties. <br /> 2. The unimproved easements as they exist serve no beneficial public <br /> purpose. <br /> 3 . The affected property owners have agreed to grant new drainage <br /> and utility easements over the recently relocated lot line <br /> between the two properties. <br /> • Page 1 of 2 <br />
