NO. 2858 <br /> • - • • ` <br /> ,,�.��:. <br /> A R$SOLIITION GRANTING <br /> VARIANCSS TO <br /> MQNICIPAL ZONING CODE <br /> S$CTION 10.22, SIIBDIVISIONS 1 & 2 <br /> FII,$ #1559 <br /> WHER$AS, John and Roberta Henrich (hereinafter "the applicants") <br /> are owners of the property located at 4125 Highwood Road within the <br /> City of Orono (hereinafter "City") and legally described as follows: <br /> Lots 19 , 20 and 21, Highwood Lake Minnetonka; Hennepin <br /> County, Minnesota (hereinafter "the property"); and <br /> WHEREAS, the applica�nts have applied to the City of Orono <br /> for variances to Municipal Zoning Code Section 10.22, Subdivisions 1 <br /> & 2 to permit the construction of a room addition, detached garage, <br /> and decks, such decks encroaching past the average lakeshore setback <br /> line where no encroachment is normally allowed, and such improvements <br /> overall constituting additional hardcover in the 75-250' lakeshore <br /> � setback zone in excess of the 25� hardcover normally allowed. <br /> , NOW, THEREFORE, BE IT R$SOLVED by the City Counci 1 of Orono, <br /> Minnesota: <br /> � FINDINGS <br /> l. This application was reviewed as Zoning File #1559 . <br /> 2. The property is located in the LR-1B Single Family Lakeshore <br /> Residential Zoning District. <br /> 3. The Orono Planning Commission reviewed this application on <br /> July 16, 1990 , and on a vote of 5 to 0 recommended approval of <br /> the proposed variances based upon the following findings: <br /> a. Due to the location and orientation of neighboring <br /> residences; the average lakeshore setback encroachment has <br /> no significant• impact on views of the lake enjoyed by <br /> neighboring property owners. <br /> b. Hardcover on the property is 43.6� in the 75-250' zone. <br /> There is excess driveway hardcover on the property that can <br /> be removed in conjunction with the proposed additions, <br /> resulting in no net increase in hardcover on the property <br /> above the pre-existing 43.6$ level in the 75-250' zone. <br /> �� <br /> Page 1 of 4 <br />
