Denzel (hereinafter "the <br /> applicants") are owners of the property located at 1295 Elmwood <br /> Avenue within the City of Orono (hereinafter "City") •and legally <br /> described as Lot 3, Block 5, Saga Hill Revised, Hennepin County, <br /> Minnesota (hereinafter "the property"); and <br /> WHEREAS, the applicants have applied to the City for <br /> variances to Municipal Zoning Code Section 10.22, Subdivision 1 <br /> to permit the encroachment of 2' by an access stair where no <br /> encroachment is allowed; and per Section 10.22, Subdivision 2 <br /> seeks approval of a hardcover variance within the 75-250' setback <br /> area resulting in a total of 32.4� where only 25$ is allowed. <br /> • The property already contains 31$ hardcover within the protected <br /> area resulting in a net increase of 125.8 s.f. or 1.49� ; and per <br /> Section 10.24, Subdivision 5 (B) , seeks approval of a side <br /> setback variance for a second floor dormer expansion of portions <br /> of the structure located within the required 10' side yard <br /> setback. � <br /> , NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of <br /> Orono, Minnesota: <br /> � FINDINGS <br /> 1. This application was reviewed as Zoning File #1563. <br /> 2. The property is located in the LR-1B Single Family Rural <br /> Residential Zoning District requiring 1 acre in area. The <br /> property consists of 12,789.7 s.f. or .29 acres. <br /> 3. The Orono Planning Commission reviewed this application <br /> on July 16, 1990, and recommended appro�val of the proposed <br /> variances based upon the following findings: <br /> A) The 2' encroachment of the access stairs will <br /> provide no visual impact to the adjacent residences <br /> because of the sloping topographies of the lakeshore <br /> yards. <br /> • B) The location of the proposed garage will now <br /> improve safety/traffic conditions for the users of <br /> Elmwood Drive. � <br /> , Page 1 of 5 <br />
