The Orono City Council reviewed this application on July 23, <br /> . 1990 and finds that replacement of the existing deteriorating <br /> detached garage in kind and in the existing conforming location, <br /> wi 11 provide a benef it to the property and to the neighborhood <br /> whi le not changing the existing percentage of hardcover on the <br /> property. <br /> �, <br /> 4. The Council further finds that the revised proposal is of <br /> such a minor magnitude as to require no further review by the <br /> Orono Planning Commission. <br /> 5. The City Council has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by City staff, comments by the applicant and the effect <br /> of the proposed variance on the health, safety and welfare of the <br /> community. <br /> � 6. The City Counci 1 .f inds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> -� property in this zoning district; that gran�ing the variance <br /> would not adversely affect traffic conditions, light, air nor <br /> pose .a fire liazard or other danger to neighboring property; would <br /> not merely serve as a convenience to the applicant, but is ' <br /> necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the <br /> applicant; and would be in keeping with the spirit and intent of <br /> the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby . <br /> grants a variance to Municipal Zoning� Code Section 10.22, Subdivision <br /> 2 to permit the replacement of the existing detached 26' x 22' garage, <br /> allowing continuation of the existing 33.7� hardcover in the 75-250' <br /> zone where only 25� hardcover is normally allowed, subject to the <br /> following conditions: <br /> 1. Applicant shall submit suitable construction plans for City <br /> staff review and approval, verifying that the proposed garage <br /> will not exceed the current footprint dimensions and meet all <br /> other City requirements. <br /> � Page 2 of 4 <br /> � <br />
