The property contains 3,604 square feet (34.3�) of existing <br /> hardcover in the 75-250' setback zone. The proposed hardcover in <br /> the 75-250' zone, including the 165 square feet of gravel over <br /> � plastic, is 3,769 square feet or 35.9$. <br /> 5. There is an existing boathouse in the 0-75' setback zone, <br /> which is partially located within the adjacent city alleyway. <br /> The total hardcover in the 0-75' setback zone is 544 square feet <br /> or 12.4$. <br /> 6. On June 18 , 1990 , the Planning Commission reviewed this <br /> request for renewal of the hardcover variance to allow 35.9� in <br /> the 75-250' zone, and recommended approval based on the following <br /> finding: <br /> A) Renewal is requested only for the hardcover variance, <br /> because code changes since the original adoption of <br /> Resolution #1991 result in no need for the street setback <br /> variance for the proposed garage. ' <br /> • � B) The room additions to the existing residence were <br /> completed within the requests of Resolution #1991, and <br /> necessary concurrent hardcover removals for that work were <br /> completed. <br /> C) The current garage size and location proposed are <br /> , identical to those previously approved in Resolution #1991. <br /> 7. The City Council has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by City staff , comments by the applicant and the effect <br /> of the proposed variance on the health, safety and welfare of the <br /> community. � <br /> 8. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance <br /> would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would <br /> not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the <br /> applicant; and would be in keeping with the spirit and intent of <br /> the Zoning Code and Comprehensive Plan of the City. <br /> Page 2 of 5 <br /> • <br />
