RESOWTION OF THE CITY COUNCIL <br /> � NO. 2830 <br /> � - • • <br /> A RESOLIITION GRANTING <br /> A VARIANCE TO <br /> MDNICIPAL ZONING CODE <br /> SECTION 10.28, SUBDIVISION 5 (B) <br /> FILE #1541 � <br /> WHEREAS, Dr. Roby & Jane .Thompson (hereinafter "the <br /> applicants" ) are owners of the property located at 1520 <br /> Tanglewood Road within the City of Orono (hereinafter "City") and <br /> legally described as follows: <br /> Lot l, Block 1, Tanglewood, Hennepin County, Minnesota <br /> (hereinafter "the property"); and <br /> WHEREAS, the app licant has app lied to the City for a <br /> variance to Municipal Zoning Code Section 10.28, Subdivision 5 <br /> (B) to permit the construction of room additions located less <br /> than 50' from the rear lot line where a 50' rear yard is norm�lly <br /> required. � <br /> � NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1 . This application was reviewed as Zoning File #1541. <br /> � 2. The property is located in the RR-1B Single Family <br /> Rura1 Residential Zoning District. <br /> 3. The Orono Planning Commission reviewed this application <br /> on June 18, 1990, and recommended approval of the proposed <br /> variance based upon the following findings: <br /> A) Variance application #470 was approved in 1979'; <br /> allowing the house to be constructed 20' from the north <br /> lot line. The house was actually constructed 26' from <br /> the north lot line. The currently proposed additions <br /> will at their closest point be 21.9' from the narth lot <br /> 1ine, meeting the intent of tYie original variance ` <br /> approval. <br /> B) The original variance was granted because of <br /> extremely limited drainfield sites, topogrpahy, and <br /> wetland on the site.
