Due to the topography and shape of the lot, the majority of the driveway for the
existing home is located in the right -of -way along with some other encroachments.
The applicants' proposal includes a setback variance from the right -of -way to allow a 10 -foot setback
where a 15 -foot setback is required; an average lakeshore setback variance to allow a small portion of the
covered porch to partially encroach two to three feet; and a hardcover variance to allow 46 percent
hardcover. All of the encroaching improvements within the right -of -way are proposed to be removed and
the right -of -way will be restored with vegetation.
The Planning Commission voted 5 -0 to recommend approval of the request. Staff also recommends
approval of the variances.
Curtis noted this application has received supporting comments from the neighbor to the north, who •
would be affected by the average Lakeshore setback variance. Public Works has also commented today on
the applicant's right -of -way vegetation plan and they are satisfied with the proposed improvements. The
Page 14 of 22
