NO. 2769 <br /> ,.rti <br /> . �.-..:, � , <br /> ,,�"::: '�a�� <br /> =� <br /> CONCLDSIONS, ORDER AND CONDITIONS <br /> Based ugon one or more of the findings noted above, the Orono <br /> City Council hereby grants variances to Municipal Zoning Code Section <br /> 10e22, Subdivisions 1 and 2 to permit the construction of a new residence <br /> structure using the existing foundation subject to the following <br /> � conditions : <br /> 1. All hardcover scheduled for removal must be completed pri�r t� the <br /> final inspection by the Building staff for the new construction. <br /> Please refer to Exhibit A of this resolution for hardcover areas <br /> designated for removal . <br /> 2. Applicant to provic3e a Highway Department permit for the relocated <br /> curb cut to the site. <br /> • 3. Agplicant or aFplicant's architect shall provide the Building <br /> staff with the engineering data or findings that confirm the existing <br /> foundation can sustain the pro�osed 2-story structure at the time af <br /> application for a building permit. Applicant is hereby advised that, <br /> if for any reason unknown at this time, the existing foundation cannot <br /> be used, variance apFlication #1491 shall be scheduled for further <br /> consideration before both the Planning Commission and the Council. <br /> 4. Authorities granted by this resolution run with the property not <br /> with the ag�licant, but are germissive only and must be exercised by <br /> application for a building Fermit within one year of the date of <br /> Council a�proval, or this resolution will expire on that date (March <br /> �2 , 1991) . <br /> 5. Violation of or non-compliance with any of the terms and <br /> conditions of this variance shall constitute a violation of the zoning <br /> code, shall automatically terminate any authority granted herein, and <br /> shall be punishable as a misdemeanor. <br /> 6. The undersigned app licant has read, understood and hereby agrees <br /> to the terms of this resolution and on behalf of himself, his heirs, <br /> successors and assigns, hereby agrees to the recording of this <br /> resolution in the chain of title of the property. <br /> • <br /> Page 3 of 5 <br />
