FILF NO. 1480 � � � <br /> WHEREAS, the City of Orono is a municipal corporation <br /> � organized and existing under the laws of the State of Minnesota; <br /> and . . . . __ .. . . <br /> WH$REAS, on October 27, 1989, Ed and Gerta Toth filed a <br /> petition with the City of Orono requesting the vacation of <br /> , portions of drainage easements originally dedicated within the � <br /> • plat of FARVIEW, said portions to be vacated being legal3y <br /> described as fo3.lows: <br /> The west 40' of the east 50' of the south 190' of the north <br /> 200' of Lot 12, Block 1, FARVIEW, according to the recorded <br /> plat thereof, Hennepin County, Minnesota. Also: ' � <br /> That portion of drainage easement within Lot 12, Block l, <br /> FARVIEW, lying west of the east 100' and northerly of the <br /> southerly 30' thereof. <br /> WH$REAS, after due published and posted notice, a <br /> public hearing was, held before the Planning Commission on <br /> November 20, 1989, regarding said vacation and aI3. interested <br /> persons were given an opportunity to be heard; and <br /> WH$R$AS, after due standing and consideration, the <br /> P3_anning Commission voted to recommend approva3 of the requested <br /> vacation and the Council of the City of Orono finds that said <br /> vacation, as proposed, is in keeping with the pub].ic interest in <br /> consideration of the following findings: <br /> l. The vacation does not affect access to or use of any <br /> adjoining property. . <br /> • 2 . The City has not and does not intend to develop, <br /> improve or use the portions of dedicated drainage easements <br /> described above. <br /> 3.
