The existing porch is
37.1 feet from Briar Street. A 50 foot setback is required. -
Hardship Statement
Applicant has completed the Hardship Documentation Form attached as Exhibit B, and
should be asked for additional testimony regarding the application.
Hardship Analysis • • •
In considering applications for variance, tl:e Planning Commission sl:a[1 consider t1:e effectof tlte proposed
'variance upon tlte liealt/z, safery and welfare of t/:e community', existing and anticipated traffic conditions,
ligl:t and air, danger of fire, risk to tl:e public safety, and t/ie effect on values of property in t1:e surrounding
area. Tl:e Planning Comnission sl:all consider recommending approva! for variances from tJ:e literal
provisions of tlze Zoning Code in instances w/iere tlieir strict enforcement would cause undue /:ardsl:ip
because of circumstances unique to tl:e individual property under consideration, and slzall recommend
approval only wl:en it is demonstrated tltat sucJt actions wi!!be in keeping witle t/ie spirit and intent of tlie
Orono Zoning Code.
Issues for Consideration
Would the addition be compatible with the surrounding area? If this property were zoned R-
1B, a zoning district that requires a half acre lot, the front setback would be 30 feet. The
houses to the north on Briar Street have similar setbacks. The house to the south was built in
1992 so it has the required 50 foot setback. But because of an angle in the roadway it lines
up with the other houses on the block.
Are there any other issues or concerns with this application?
Staff Recommendation
Planning Staff recommends approval.
