OF STRIICTURES AT <br /> . 1949 FAGERNESS POINT ROAD, ORONO <br /> THIS R$SOLIITION H$REBY SUPERSEDES <br /> R$SOLDTION #2713 <br /> WHEREAS, the City of Orono is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; <br /> and <br /> WHEREAS, Steven Davis is the fee owner of record of <br /> property Iocated at 1949 Fagerness Point Road, Orono, Minnesota, <br /> herein referred to as "the property", and Iegally described as <br /> follows: <br /> Property Identification Number: 18-117-23 14 0016 <br /> Lots 23 and 24 including accretions described as fol].ows: <br /> • commencing at most northerly corner of Lot 24, thence south- <br /> westerl.y to most westerly corner thereof , thence <br /> southeasterly at a def lecting ang3e to the left of 60 <br /> degrees 36 minutes to the south Iine of Under the Linden <br /> Avenue said point being the actua� point of beginning, <br /> thence continued southeasterly on said angle Iine a distance <br /> of 61. 05 feet thence northeasterly to a point in the <br /> extension southerly of east line of Lot 23 distance 57.05 <br /> feet south from south line of Under the Linden Avenue thence <br /> northerly along east Iine of Lot 23 extended to south line <br /> of said avenue, thence westerly a3ong said south line to <br /> beginning, Fagerness, Hennepin County, Minnesota; and <br /> WHEREAS, the City Council of the City of Orono, having <br /> duly considered the matter pursuant to Minnesota Statutes <br /> Sections 463.15 to 463.261, hereby finds that the above described <br /> property is uninhabitab3e and contains unsanitary and hazardous <br /> conditions which constitute a public nuisance and which makes <br /> this property hazardous to the public hea3th, safety and welfare <br /> based on the fo3lowing findings: <br /> 1. Basement wa3.1 backplastered over dirt for foundation <br /> waI I, northwest corner. Three-quarters of northwest wall is <br /> of 2 tier construction and is cracked and severely bowed. <br /> 2. Basement wall caving in at cellar door. <br /> , 3. Improper beam support over doorway in basement. <br /> • ' <br /> 4.
