L <br /> �''p,.~ .'+ ' •`` . . <br /> .i{ <br /> ` ' ` Clt� o� ORONO . <br /> �:� �: <br /> � � ' � f1, <br /> �: <br /> RESOLUTION OF THE CITY COUNCIL <br /> �, .`:.�m NO. 2727 <br /> � ' • • <br /> A RBSOLIITION VACATING <br /> A IITII�ITY EASEMENT � <br /> WITHIN LOTS 1 AND 2, BLOCR 3, FOX HILL <br /> SECTION 10, TOWNSHIP 117, RANG$ 23 • <br /> IN THE CITY OF ORONO, HENNEPIN COIINTY, MINNESOTA <br /> FILE NO. 1413 <br /> WH$REAS, the City of Orono is a municipal corporation <br /> organized and existing under the Iaws of the State of Minnesota; <br /> and <br /> WH$REAS, on May 24, 1989, Daniel A. Hoffman and Jorgen <br /> Viltoft filed a petition with the City of Orono requesting the <br /> vacation of a utility easement orginally dedicated within the <br /> plat of Foxhill and legally described as follows: <br /> A utility easement, being 5' on each side of the lot <br /> • line between Lots 1 and 2, Block 3, Foxhill, according <br /> to the recorded plat thereof , Hennepin County, <br /> Minnesota and runs from the easterly line of said Lots <br /> 1 and 2, a distance of 20 feet westerly. <br /> � <br /> WHEREAS, after due published and posted notice, a <br /> public hearing was held before the Pl.anning Commission on <br /> June 19, 1989 regarding said vacation and all interested persons <br /> were given an opportunity to be heard; and <br /> WHEREAS, after due standing and consideration, the <br /> � Planning Commission voted to recommend approval of the requested„ <br /> vacation and this Council of the City of Orono finds that said <br /> vacation as proposed is in keeping with the public interests and , <br /> in consideration of the fol lowirig findings: � <br /> l. The 20 feet length portion of the utility easement <br /> serves no public purpose. <br /> 2. The location of the utility easement within Lot l, Block <br /> 3, Foxhill, as amended by a recent subdivision of a lot line <br /> rearrangement finds the above-described utility easement to <br /> place severe restrictions on the building envelope. <br /> NOW, THEREFORE BE IT R$SOLVED, that the petition of <br /> Daniel A. Hoffman and Jorgen Viltoft is hereby granted by the <br /> • Council of the City of Orono and that the portion of the <br /> dedicated utility easement legally described above is hereby <br /> vacated. <br /> Page 1 of 2 <br />
