This court . <br /> has existed on the property for many years, and is a major factor in the non- <br /> conformity of the property with current hard cover limitations. The applicant is <br /> proposing to move the court to the street side in the interest of limiting the amount � <br /> of hardcover that is required for the court, while balancing the location of the <br /> home to meet the new requirements of the building height calculations. . <br /> While the home could be re-positioned, to enable the applicant to more closely <br /> meet the hardcover requirements, site topography,prohibits these changes, as <br /> additional variances to building height would then be required. <br /> 2. The topography of the site requires the tennis court to be in one of two locations— <br /> - toward the lake, as it exists presently, or toward the street side. Applicant favors <br /> street side in the interest of protecting the beauty of the lakeshore, for <br /> � maintenance purposes, and in the interest of keeping the run-off as far form the <br /> lake as is possible, allowing for control through rain gardens or other water <br /> features. � <br /> The topography of the site dictates the location of the home, driven by the <br /> building height rules. One of the features of this property that attracted the <br /> applicant to the property is the tennis court. Since moving to this location,tennis <br /> has become an integral part of their family life. . <br /> 3. A tennis court cunently exists on the property, and several tennis courts exist <br /> along the various Casco streets. Courts exist at 2975, 2835 & 3225, and all are on <br /> the street side of the property. . <br /> 4. Economic considerations are not the primary factor. <br /> 5. This application does not concern matters of sunlight or that of earth sheltered <br /> construction. <br /> 6. Our requested uses are not prohibited under any other sections of the zoning code. <br /> All other requirements are met, or exceeded by our application. <br /> 7. Not Applicable. � <br /> 8.
