This was never the intent to allow these fixtures <br /> as an accessory use; rather it should have been listed within the Conditional Use section as it is <br /> in the other residentially zoned properties. Staff feels that this was likely an error in the re- <br /> codification process of the City Code which was completed in 2003. Therefore, Staff is <br /> correcting this error and allowing the installation of toilets as an accessory use to all residential <br /> districts. The covenant prohibiting the use of the accessory structure as a dwelling, or for a <br /> home occupation will continue to be required. And finally, the installation of a bathtub or shower <br /> will still require conditional use approval. <br /> The Planning Commission discussed both of these code amendments at the February 2008 <br /> work session.
